9.5 Warranty and liability

WEPA Apothekenbedarf GmbH & Co KG (hereafter referred to as "the Manufacturer") grants
the end customer (hereafter referred to as "the Customer") based in ... a 3-year warranty from
the date of delivery to the customer for the TOPITEC
referred to as "Product") stating that the product will be free of material or processing faults
for this period (warranty period). The Manufacturer reserves the right to choose between a
repair and the supply of new or fully reconditioned parts in relation to faults alleged in connec-
tion with this warranty. The warranty terms do not in any way affect the Customer's contractual
and statutory rights.
Not covered by warranty are:
• Damage or wear to the Product caused by improper or incorrect operation that is in
contravention of best practice and the instructions of the Manufacturer (as laid down
in this operating manual)
• Products that show signs of interference or (attempted) repair by a workshop that is not
authorised by the Manufacturer to carry out such repairs
• Products that have been modified or operated with unapproved accessories
• Products whose serial number has been removed or made illegible on the type plate
To make a claim under warranty, the Customer must notify the Manufacturer prior to returning
the Product by calling +49 (0)2624 107-361 or writing to info@wepa-apothekenbedarf.de
The Customer must allow the Manufacturer a period of 5 working days for the performance of
a preliminary fault analysis (by telephone). Claims under this warranty shall only be considered
after the Product has been returned to the Manufacturer to the following address:

Customers based outside Germany may return the Product to their local dealer. To make a
claim under warranty, please also furnish us with the original invoice bearing the date of
purchase. The costs for the return of the Product shall be covered by the Manufacturer.
If a claim is made under warranty, and the inspection of the Product by the Manufacturer
reveals that there is no fault, or that the damage is not covered by warranty for one of the
reasons listed above, the Manufacturer shall be entitled to charge a reasonable service fee.
This does not apply in cases where the Customer can prove that he could not be aware of
the fact that the warranty had been voided.
The Manufacturer warranty as outlined above, including all terms and conditions, shall
be transferrable to any new owner based in ..., provided that the original purchase invoice
is submitted.
This warranty is governed by German law.
