Festo gewährleistet jedoch nicht, daß die
gelieferte Elektronische Dokumentation mit
dem vom Verwender genutzten Produkt
übereinstimmt. Letzteres gilt insbesondere
bei auszugsweisem Gebrauch für eigene
Dokumentationen des Verwenders.
2. Festo haftet ferner nicht für mangelnden
wirtschaftlichen Erfolg oder für Schäden
oder Ansprüche Dritter, mit Ausnahme von
Ansprüchen aus der Verletzung von Schutz-
rechten Dritter, die die Nutzung der Elektro-
nischen Dokumentation betreffen.
3. Die Haftungsbeschränkungen nach Absatz
1. und 2. gelten nicht, soweit in Fällen von
Vorsatz oder grober Fahrlässigkeit oder
Fehlen zugesicherter Eigenschaften eine
zwingende Haftung besteht. In einem sol-
chen Fall ist die Haftung von Festo auf
denjenigen Schaden begrenzt, der für
Festo nach der Kenntnis der konkreten
Umstände erkennbar war.
Sicherheitsrichtlinien/Dokumentation
Gewährleistungs- und Haftungsanspruch nach
Maßgabe der vorstehenden Regelungen (Ziff.
III. u. IV) sind nur gegeben, wenn der Anwen-
der die Sicherheitsrichtlinien der Dokumentati-
on im Zusammenhang mit der Nutzung der
Maschine und deren Sicherheitsrichtlinien be-
achtet hat. Für die Kompatibilität der Elektroni-
schen Dokumentation mit dem vom Anwender
genutzten Produkt ist der Anwender selbst ver-
antwortlich.
Festo does not guarantee that the electro-
nic documentation supplied corresponds to
the product used by the user. The latter
applies also to the use of extracts for the
user's own documentation.
2. Festo is also not liable for lack of economic
success or for damages or claims from
third parties, with the exception of claims
arising from violation of the protective rights
of third parties concerning the use of the
electronic documentation.
3. The limitations of liability specified in para-
graphs 1 and 2 do not apply in cases of
malice aforethought or gross negligence
where liability is compulsory. In such ca-
ses, Festo's liability is limited to the dam-
ages recognizable to Festo based on the
situation at hand.
Safety regulations/Documentation
The guarantee and liability claims specified
above (sections III and IV) only apply if the
user has observed the safety regulations in the
documentation and the safety regulations re-
garding the use of the machine. The user is
responsible for ensuring the compatibility of the
electronic documentation with the machine he
is using.
