7.8 Limitation de la responsabilité
La responsabilité du Concédant pour tous les dommages et dépenses liés à l'utilisation du Logiciel
et imputés au Licencié est - nonobstant de la nature juridique de la revendication concernée - limitée
comme suit :
Pour les dommages imputés au Licencié résultant d'une négligence grave ou d'une faute intentionnelle
du Concédant ou pour faute portant à la vie, au corps ou à la santé, ou pour faute pour laquelle il y a
une obligation légale impérative de responsabilité, le Concédant engagera sa responsabilité selon les
dispositions légales .
Pour tous les autres dommages, l'obligation à dommages et intérêts du Concédant est limitée à la
violation des obligations contractuelles essentielles . Les obligations essentielles sont celles dont
l'exécution est une condition primordiale à la bonne exécution du contrat et au respect desquelles le
Licencié peut se fier .

Dans le cas d'une violation par négligence d'une obligation contractuelle essentielle par le concédant, la
responsabilité est limitée aux dommages prévisibles au regard du contrat .
La responsabilité du Concédant pour la perte de données est limitée aux dépenses typiques et
nécessaires pour la récupération qui sont normales et usuelles si des copies de sauvegarde ont été
créées régulièrement . Le Licencié a l'obligation de créer régulièrement des sauvegardes des données .
7.9 Droit applicable
Ce contrat et toutes les autres relations juridiques y liées sont de droit allemand .
Tout litige survenant à l'occasion du présent contrat sera de la compétence des juridictions d'Essen,
Allemagne .

The "Corresponding Application Code" for a Combined Work means the object code and/or source code
for the Application, including any data and utility programs needed for reproducing the Combined Work
from the Application, but excluding the System Libraries of the Combined Work .
